Alameda City Prosecutors File Charges Against Person Burglarizing the USS Hornet

On October 18, 2023, Assistant City Prosecutor Montague Hung, Acting Chief of the Prosecution and Public Rights Unit of the Alameda City Attorney’s Office, filed criminal charges against the man arrested by the Alameda Police Department (APD) on October 17th, while burglarizing the USS Hornet Aircraft Carrier Museum Ship, docked on the southernmost pier of the former Naval Air Station Alameda. Charges include: 1) Second Degree Burglary in violation of Penal Code Section 459, 2) Theft in violation of Penal Code Section 484(a), and 3) Trespass in violation of Penal Code Section 602(o).

According to the Probable Cause Declaration filed with the criminal complaint, APD Officers timely responded to a call of a burglary in progress at the Hornet. Live surveillance video onboard the Hornet showed the Defendant taking items from the ship. APD Officers arrived while the Defendant was still on the ship and made the arrest.

“Community Safety has consistently been one of the City Council’s highest priorities,” said City Attorney Yibin Shen. “City Prosecutors are committed to working collaboratively with our justice partners at the Alameda Police Department to effectuate the Council's and the Community's priorities.”

“The Alameda Police Department values the partnership and collaboration with the Alameda City Attorney’s Office,” said Chief of Police Nishant Joshi. “Our unique collaborations continue to be critical in enhancing public safety in the City of Alameda.”

Alameda voters adopted Measure AA in November 2020, which amended the City Charter by directing the City Attorney’s Office to prosecute State law misdemeanor and wobbler (crimes that could be prosecuted as misdemeanors and felonies) offenses that occur in the City.  In addition to criminal prosecutions, the Prosecution and Public Rights Unit further handles violations of consumer protection, labor, and fair housing laws; and educates the public about its rights and responsibilities in those areas. City prosecutors are dedicated to promoting and improving public safety and the quality of life in Alameda, through the fair, compassionate and effective administration of justice.
